Terms of Service

1. Who we are

GroWell Referrals is a software product designed to help wellness studios and centres run and track referral programmes. References to "we", "us" and "our" refer to the team behind GroWell Referrals.

2. Early access and changes

GroWell Referrals is currently offered as an early-access product. Features may change, be added or removed as we develop the service.

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you. Your continued use of the service after changes take effect will constitute acceptance of the updated Terms.

3. Your responsibilities

When you use GroWell Referrals, you agree to:

• Provide accurate account and contact information and keep it up-to-date.
• Ensure you have a lawful basis to upload or use client and referrer data in the product.
• Use the service in compliance with applicable laws and regulations, including data protection rules in your jurisdiction.
• Keep your login details secure and notify us promptly of any unauthorised access.

4. Data and privacy

Our handling of personal data is described in our Privacy Policy. By using GroWell Referrals, you also agree to our Privacy Policy.

You are responsible for ensuring that your use of client and referrer data in GroWell Referrals complies with your own privacy notices and legal obligations.

5. Fees and early access

During the early-access period, GroWell Referrals may be offered free of charge for an agreed time. Any future paid plans or fees will be communicated clearly in advance, and you will have the choice to continue on a paid plan or stop using the service.

6. Availability and changes to the service

We aim to keep GroWell Referrals available and functioning, but we do not guarantee uninterrupted or error-free operation. We may suspend or modify the service for maintenance, security or other reasons.

We may also discontinue the early-access programme or the service itself, in which case we will take reasonable steps to give advance notice where practical.

7. Limitation of liability

To the extent permitted by law, we are not liable for any indirect or consequential loss, or loss of profits, revenue or data arising from your use of GroWell Referrals.

Our total liability for any claims arising out of or relating to the service will be limited to the amount you have paid for the service in the 12 months before the claim (if any). During the free early-access period, this cap will be zero.

8. Termination

You may stop using GroWell Referrals at any time. We may suspend or terminate your access if you materially breach these Terms or use the service in a way that could harm the platform or other users.
